Terms of Service

1. About Treapy

These Terms of Service ("Terms") govern your use of the Treapy mobile application and any related services operated by Treapy Ltd, a company registered in England and Wales ("Treapy", "we", "us", "our"). By creating an account or using Treapy, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree with any part of them, you must not use Treapy.

2. Not Financial Advice

Treapy is not a financial adviser and is not regulated by the FCA.

Nothing in the Treapy app - including portfolio data, charts, insights, alerts, or AI responses - constitutes financial advice, investment advice, investment recommendations, or a solicitation to buy or sell any financial instrument.

Treapy is a personal finance tracking and portfolio aggregation tool designed to help you monitor your investments in one place. All information displayed in Treapy is for informational and educational purposes only.

Treapy Ltd is not authorised or regulated by the Financial Conduct Authority (FCA) to provide regulated financial services or financial advice. If you require financial advice, please consult a qualified financial adviser who is authorised and regulated by the FCA.

3. Tripp AI - For Information Only

The Tripp AI assistant is an informational tool powered by artificial intelligence. By using Tripp, you acknowledge and agree that:

  • Tripp's responses are generated by AI and may be incomplete, inaccurate, or outdated
  • Nothing Tripp says constitutes financial, investment, tax, or legal advice of any kind
  • You must not rely on Tripp's responses as the basis for any investment or financial decision
  • Tripp's responses are for general informational and educational purposes only and are not tailored to your personal financial circumstances
  • Market conditions, prices, and relevant regulations change frequently; Tripp may not reflect current information

You use Tripp entirely at your own risk. Treapy accepts no liability for any loss or damage, financial or otherwise, arising from reliance on Tripp's responses.

4. Eligibility

You must be at least 18 years old to use Treapy. By creating an account, you confirm that you are at least 18 years old. Treapy reserves the right to terminate accounts where there is reason to believe this requirement is not met.

Treapy is currently available to residents of the United Kingdom and European Union. Availability in additional jurisdictions will be announced on treapy.co as it expands. If you access Treapy from a jurisdiction where it is not yet officially available, you do so at your own risk and are solely responsible for compliance with all applicable local laws and regulations.

5. Account Security

You are solely responsible for:

  • Maintaining the confidentiality of your Treapy account credentials
  • Keeping your email address and password secure and not sharing them with any other person
  • All activity that occurs under your account, whether or not authorised by you

You must notify Treapy immediately of any unauthorised access to your account or any breach of security by emailing support@treapy.co. Treapy accepts no liability for losses or damages arising from your failure to maintain the security of your account credentials.

6. Connected Accounts

Treapy integrates with third-party financial services to aggregate and display your portfolio data. When you connect accounts, the following applies:

6.1 Open Banking (via TrueLayer)

When you connect a bank account, you authorise TrueLayer (acting as Account Information Service Provider on Treapy's behalf) to retrieve read-only information including account balances and transaction history. Treapy will never initiate payments, transfers, or any financial transaction from your bank account.

6.2 Brokerage Accounts (via SnapTrade)

When you connect a brokerage account, you authorise SnapTrade (acting on Treapy's behalf) to retrieve read-only information including portfolio holdings and transaction history. Treapy will never place orders, execute trades, or instruct any action on your brokerage account.

6.3 Cryptocurrency Exchanges

When you connect a cryptocurrency exchange via API key, Treapy retrieves read-only portfolio data. See Section 7 for full details on API key requirements and handling.

The availability and accuracy of data from all connected accounts depends on the relevant third-party providers (TrueLayer, SnapTrade, exchanges) and is outside Treapy's control. Treapy accepts no liability for errors, delays, or interruptions in data caused by third-party providers.

7. Exchange API Keys

You must use read-only API keys only.

Never provide Treapy with an API key that has trade, withdrawal, transfer, or any other non-read permission. Treapy accepts no liability whatsoever for any losses arising from your provision of API keys with permissions beyond read-only access.

When you connect a cryptocurrency exchange using an API key, you agree that:

  • You will configure the API key with read-only permissions only, with no trading, withdrawal, transfer, or withdrawal capabilities
  • Treapy will encrypt your API key at rest using AES-256 encryption
  • Treapy will never use your API key to place trades, initiate withdrawals, or take any financial action on your behalf under any circumstances
  • You are solely responsible for generating, managing, and revoking API keys on the relevant exchange platform

If you suspect that an API key connected to Treapy has been compromised, revoke it immediately on the exchange's platform and contact us at support@treapy.co.

8. Self-Custody Wallets

When you connect a self-custody wallet via WalletConnect v2:

  • Treapy receives read-only visibility of your on-chain balances and transaction history
  • Treapy will never request a transaction signature or attempt to initiate, approve, or influence any on-chain action or transaction
  • You remain in full control of your wallet and private keys at all times
  • Treapy will never request, store, or transmit your private keys or seed phrase under any circumstances

Treapy is not responsible for any losses arising from: the use of WalletConnect or any third-party wallet software; vulnerabilities in underlying blockchain networks; or smart contract exploits or failures.

9. Subscriptions and Billing

9.1 Subscription Plans

Treapy offers subscription plans that unlock features beyond the free tier. Current plan details and pricing are displayed in the app and at treapy.co.

9.2 In-App Purchases (Mobile)

Subscription purchases made through the Treapy iOS app are processed by Apple App Store and are subject to Apple's billing terms. Purchases through the Treapy Android app are processed by Google Play and are subject to Google's billing terms. Treapy uses RevenueCat to manage subscription entitlements. Billing disputes for in-app purchases must be directed to Apple or Google as applicable; Treapy cannot process refunds for platform-billed purchases.

9.3 Web Billing

Subscription purchases made through treapy.co are processed by Stripe. Treapy never stores your full payment card details.

9.4 Auto-Renewal

Subscriptions auto-renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your Treapy account settings or through your Apple App Store or Google Play account settings.

9.5 Cancellation

Cancelling your subscription ends access to paid features at the end of the current billing period. We do not offer refunds for unused portions of a billing period, except where required by applicable law in your jurisdiction.

9.6 Price Changes

We will give you at least 30 days notice of any subscription price increase, by email or in-app notification. Continued use of Treapy after a price increase takes effect constitutes your acceptance of the new price.

10. Free Tier

Treapy offers a free tier with a baseline set of features. The features included in the free tier and any applicable limits are displayed in the app and on treapy.co. Free tier limits may be updated from time to time; Treapy will provide reasonable notice of any reduction in the free tier.

Features above the free tier limits require an active paid subscription. Accessing paid features requires a subscription to the relevant plan.

11. Prohibited Uses

When using Treapy, you must not:

  • Scrape, crawl, or extract data from the app or its APIs by automated means without Treapy's prior written consent
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the app
  • Attempt to gain unauthorised access to Treapy's systems, servers, databases, or to any other user's account
  • Facilitate or engage in market manipulation, insider trading, wash trading, or any other illegal financial activity
  • Share your account credentials or account access with any other person
  • Use Treapy in any way that violates applicable laws or regulations in your jurisdiction
  • Introduce malware, viruses, worms, ransomware, or other malicious code into the app or Treapy's systems
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Use Treapy to provide financial services to third parties without appropriate authorisation

Treapy may suspend or terminate accounts that violate any of the above prohibitions, without prior notice, at our sole discretion.

12. Intellectual Property

12.1 Treapy's intellectual property

Treapy Ltd owns all rights, title, and interest in and to the Treapy app, website, branding, visual design, Tripp persona, underlying algorithms, and all content produced by Treapy. You may not copy, reproduce, modify, distribute, or use Treapy's name, logo, or branding without our prior written consent.

12.2 Your data

Your financial data (bank account information, portfolio holdings, transaction history, wallet addresses) belongs to you. By using Treapy, you grant us a limited, non-exclusive, worldwide, royalty-free licence to process your financial data solely for the purpose of delivering the services described in these Terms and our Privacy Policy. This licence terminates when you disconnect a linked account or delete your Treapy account.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Treapy Ltd shall not be liable for:

  • Any investment losses, trading losses, or financial decisions made using information from Treapy or Tripp
  • Errors, delays, or inaccuracies in data received from third-party providers (TrueLayer, SnapTrade, cryptocurrency exchanges, market data providers)
  • Market data inaccuracies or delays (all prices are for informational purposes and may not reflect real-time trading prices)
  • Any indirect, incidental, consequential, special, or punitive damages
  • Loss of profits, loss of data, or loss of goodwill
  • Losses arising from the use of self-custody wallets, WalletConnect, or blockchain networks
  • Losses arising from your provision of API keys with permissions beyond read-only access
  • Service interruptions caused by third-party providers, infrastructure outages, or events outside Treapy's reasonable control

Treapy's total aggregate liability to you in any 12-month period shall not exceed the total subscription fees you paid to Treapy during that period.

Nothing in these Terms limits Treapy's liability for: fraud or fraudulent misrepresentation; death or personal injury caused by negligence; defective digital content where liability cannot lawfully be excluded under the Consumer Rights Act 2015; or any other liability that cannot be excluded or limited by English law.

14. Market Data Accuracy

Market prices, portfolio valuations, and all financial data displayed in Treapy may be delayed, estimated, incomplete, or inaccurate. Data is sourced from third-party market data providers and exchange APIs and may not reflect real-time trading prices.

All market data in Treapy is provided for informational purposes only. Treapy makes no warranty, express or implied, as to the accuracy, timeliness, or completeness of any market data. Do not rely on Treapy data for real-time trading decisions or as the sole input to any financial decision.

15. Service Availability

We do not guarantee uninterrupted or error-free access to Treapy. The service may be unavailable due to planned maintenance, unplanned outages, third-party provider failures, or events outside Treapy's control. Where planned maintenance is scheduled, we will endeavour to notify you in advance.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. For material changes to the service, we will provide reasonable advance notice. Treapy's functionality depends in part on third-party services (TrueLayer, SnapTrade, market data providers) and Treapy cannot guarantee the continued availability of integrations with those services.

16. Account Termination

16.1 Deletion by you

You may delete your account at any time through the Treapy app settings. Upon deletion, your data is handled as described in our Privacy Policy.

16.2 Suspension or termination by Treapy

Treapy may suspend or terminate your account, with or without notice, if:

  • You violate any provision of these Terms
  • We are required to do so by law, court order, or regulatory directive
  • We reasonably believe your account poses a security risk to Treapy or other users
  • Your account has been inactive for an extended period (in which case we will notify you before acting)

Where practicable, we will give you advance notice before suspending or terminating your account, unless immediate action is required for security or legal reasons. If we terminate your account without cause, we will refund any unused portion of your current subscription period.

17. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Subject to the paragraph below, any dispute arising out of or in connection with these Terms, including any dispute as to their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in another jurisdiction, you may also have rights under the mandatory consumer protection laws of your country of residence, and you may be entitled to bring a claim in the courts of your country of residence. Nothing in these Terms affects those mandatory rights.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. If we make material changes, we will notify you by email at least 30 days before the changes take effect and update the "Last updated" date at the top of this page.

Your continued use of Treapy after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you should stop using Treapy and may delete your account.
